These Terms and Conditions govern your access to and use of Merdot AI, including our website, mobile applications, AI assistant, agents, tools, subscription plans, billing features, file features, search features, image features, and related services.
By accessing, registering for, subscribing to, or using Merdot AI, you agree to these Terms and Conditions.
If you do not agree, do not use Merdot AI.
1. About Merdot AI
Merdot AI is an artificial intelligence product created and operated by Merdot Technologies.
Merdot Technologies was founded by Rajat Jangid.
Merdot AI provides AI-assisted features for:
Writing
Study
Business
Productivity
Documents
Images
Research
Content creation
Translation
Communication
Ideation
Planning
Learning
AI agents
Search-enabled workflows
File-based workflows
Merdot AI is a product experience created by Merdot Technologies and may use third-party AI model providers, APIs, tools, infrastructure, and cloud services to deliver its features.
2. AI Provider and Model Disclosure
Merdot AI may use third-party artificial intelligence models, APIs, cloud infrastructure, data processing systems, and technology providers.
These may include, but are not limited to:

Other AI model providers
Cloud service providers
Storage providers
Payment providers
Analytics providers
Security providers
The model and feature names shown inside Merdot AI are Merdot's own product labels. For example:

These labels may not match the official names of the underlying AI models or providers.
Merdot AI is not ChatGPT. Merdot AI is not OpenAI. Merdot AI is not Claude. Merdot AI is not Gemini.
Merdot AI is a product created by Merdot Technologies. It may use model providers through integrations, but the product interface, branding, subscriptions, agents, workflows, and user experience are provided by Merdot Technologies.
Unless expressly stated in a written agreement, Merdot AI is not sponsored, endorsed, operated, or owned by OpenAI, Anthropic, Google, or any other third-party provider.
3. Eligibility
To use Merdot AI, you must:
Be legally capable of entering into a binding agreement
Provide accurate account information
Use the service lawfully
Follow these Terms
Follow applicable laws
Use the service only for permitted purposes
If you are under the legal age of consent in your jurisdiction, you must use Merdot AI only with parent or guardian permission.
Merdot Technologies may refuse, suspend, or terminate access at its discretion where required for safety, compliance, legal, fraud-prevention, or business reasons.
4. Account Registration
You may need to create an account to use Merdot AI.
You agree to:

Merdot Technologies may change plan limits, pricing, features, fair-use rules, and availability at any time, subject to applicable law and notice where required.
6. GST, Taxes, and Payments
Prices displayed may be inclusive or exclusive of applicable taxes depending on how they are shown at checkout.
For Indian users, digital subscriptions, software, SaaS, or IT services may attract GST. Current commercial practice for many IT/software/SaaS services in India uses 18% GST.
You are responsible for paying all applicable taxes, duties, fees, and charges related to your subscription or purchase.
Merdot Technologies may use third-party payment processors such as Razorpay or other providers. We are not responsible for failures, delays, bank declines, payment gateway issues, UPI issues, card issues, or third-party payment service errors.
7. Renewals and Cancellation
Subscriptions may renew automatically unless cancelled before the renewal date.
You are responsible for cancelling your subscription before renewal if you do not want to continue.
Access to paid features may continue until the end of the billing period unless otherwise stated.
Merdot Technologies may cancel, suspend, or restrict subscriptions if:
Payment fails
Fraud is suspected
Terms are violated
Abuse is detected
Required by law
A service provider restricts access
Technical or business reasons require it
8. Refund Policy
Unless required by applicable law or specifically stated in writing:
Subscription payments are non-refundable
Partial month refunds are not guaranteed
Credit packs are non-refundable
Add-ons are non-refundable
Used credits are non-refundable
Unused monthly limits do not carry forward unless expressly stated
Cancellation stops future renewal but does not automatically refund past payments
Merdot Technologies may offer refunds at its sole discretion in exceptional cases.
9. Usage Limits and Fair Use
Merdot AI is a usage-based AI product.
Each plan may include limits on:
Total messages
Daily messages
AI model modes
File uploads
Web searches
Image analysis
Deep reasoning
Code tasks
Team seats
Custom agents
Memory
Storage
API usage
Merdot Technologies may enforce fair-use limits even if a plan uses words such as high usage, premium access, priority, advanced, or similar language.
No plan should be understood as unlimited unless explicitly stated in writing.
Merdot Technologies may restrict, throttle, pause, or block usage that is excessive, abusive, automated, fraudulent, harmful, or outside intended use.
10. Credit Packs and Add-ons
Merdot AI may offer credit packs and add-ons.
Credits may be used for:
Additional messages
Deep AI usage
Web search
File processing
Image analysis
Code AI
Research tasks
Priority tasks
Other premium features
Credits may expire after a certain time. Credits may not be transferable, refundable, exchangeable for cash, or resold unless expressly stated.
11. Code AI Add-on
Merdot Code, Code AI, coding assistants, developer agents, debugging tools, code generation, code explanation, and similar features may be offered as separate add-ons or plans.
Coding features may be restricted, usage-limited, separately billed, or unavailable on normal plans.
AI-generated code may contain bugs, security issues, licensing issues, vulnerabilities, inaccuracies, or incomplete logic.
Users are responsible for reviewing, testing, securing, and validating all code before use in any project or production environment.
Merdot Technologies is not responsible for damages caused by AI-generated code, implementation errors, security vulnerabilities, data loss, downtime, or misuse.
12. Acceptable Use
You agree not to use Merdot AI to:
Break the law
Violate rights of others
Create malware
Conduct cyber abuse
Generate fraud
Impersonate others
Harass, threaten, or abuse people
Create non-consensual sexual content
Exploit minors
Generate unlawful surveillance
Spread misinformation intentionally
Bypass safety systems
Scrape or reverse engineer the service
Resell access without permission
Overload infrastructure
Create spam
Violate intellectual property rights
Upload illegal or unauthorized content
Circumvent plan limits
Abuse free trials
Use stolen payment methods
Misrepresent Merdot AI outputs as verified professional advice
Merdot Technologies may suspend or terminate accounts that violate these rules.
13. User Content
You are responsible for all content you submit to Merdot AI.
You represent and warrant that you have the necessary rights, licenses, permissions, and authority to submit content, including:

PDFs
Images
Screenshots
Files
Prompts
Voice inputs
Personal information
Business information
Third-party content
You must not upload confidential, sensitive, proprietary, illegal, infringing, or third-party data unless you have permission and legal authority.
14. AI Outputs and Accuracy
Merdot AI generates outputs using artificial intelligence.
AI Outputs may be:
Wrong
Incomplete
Outdated
Biased
Misleading
Similar to other outputs
Inappropriate for your exact situation
Based on incomplete user input
Based on third-party model limitations
You agree not to rely on AI Outputs as the sole basis for important decisions.
You must independently verify important information.
Merdot AI is not a substitute for:
A doctor
A lawyer
A chartered accountant
A financial advisor
A teacher

A licensed professional
A security expert
A human decision-maker

Merdot AI may help students with:

However, users must follow the rules of their school, college, university, coaching institute, exam body, or academic authority.
Merdot AI must not be used for cheating, plagiarism, impersonation, unauthorized exam assistance, or academic dishonesty.
Merdot Technologies is not responsible for disciplinary action caused by misuse of AI outputs.
16. Legal, Medical, Financial, and Professional Disclaimer
Merdot AI may generate legal-style drafts, medical-style explanations, financial-style summaries, tax-style notes, or business recommendations.
These outputs are informational only.
They are not professional advice.
You must consult a qualified professional before relying on AI outputs for legal, medical, financial, tax, investment, compliance, employment, government, or safety-related matters.
Merdot Technologies is not liable for decisions made based on AI outputs without professional review.
17. Third-Party Services
Merdot AI may depend on third-party services.
These may include:
AI model providers
Cloud hosting providers
Payment gateways
Storage systems
Analytics systems
Search providers
Email providers
Security tools
Merdot Technologies is not responsible for third-party downtime, pricing changes, service restrictions, API changes, model behavior, rate limits, outages, errors, or policy changes.
If a third-party service changes, becomes unavailable, increases cost, or restricts access, Merdot Technologies may modify, suspend, limit, or remove affected features.
18. Intellectual Property
Merdot AI, including its brand, name, logo, design, interface, software, workflows, agents, subscription structure, prompts, documentation, business logic, pricing structure, icons, product labels, and service experience, is owned or licensed by Merdot Technologies.
You may not copy, modify, distribute, sell, reverse engineer, reproduce, misuse, or create derivative products from Merdot AI without written permission.
"Merdot AI," "Merdot," and related marks are brand assets of Merdot Technologies.
19. Feedback
If you provide ideas, suggestions, feedback, bug reports, feature requests, or improvements, you grant Merdot Technologies the right to use them without restriction, payment, or obligation.
This helps us improve Merdot AI.
20. Availability and Service Changes
Merdot AI may not always be available.
Service may be interrupted due to:

All bugs will be fixed immediately
Every file will process correctly
Every answer will be suitable
Every feature will remain available
Every third-party service will continue operating
24. Indemnity
You agree to indemnify and hold harmless Merdot Technologies, its founder, employees, service providers, partners, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from:

Your violation of these Terms
Your uploaded content
Your misuse of AI outputs
Your violation of law
Your violation of third-party rights
Your account activity
Your business or academic use of outputs
Your use of AI-generated code or documents
25. Privacy
Your use of Merdot AI is also governed by our Privacy Policy.
By using Merdot AI, you agree that your information may be collected, processed, stored, and shared as described in the Privacy Policy.
26. Governing Law and Jurisdiction
These Terms are governed by the laws of India.
Subject to applicable law, disputes shall be subject to the courts located in Ahmedabad, Gujarat, India.
